PENNSYLVANIA, September 24 - "Data center developer." An entity that plans, entitles,

sites, finances and equips data centers.

"Department." The Department of Environmental Protection of

the Commonwealth.

Section 3. Study required.

(a) Water usage study.--An entity, business or land owner

proposing a data center must:

(1) Submit a comprehensive water analysis and study to

the host municipality no later than 30 days prior to a formal

development application.

(2) Use an independent, State-recognized third party,

which may be an engineering firm, to prepare the water

analysis and study.

(3) Provide data on the following for the proposed data

center, adjoining properties and the surrounding region

within a 20-mile radius of the development:

(i) Anticipated water usage, water quality and

short-term and long-term sustainability of water supply.

(ii) Other factors deemed necessary by the

department.

(4) Ensure that the water analysis and study calculates

the proposed data center's total water footprint to capture

the combined direct or onsite water use and indirect or

offsite water use embedded in a site's demand for

electricity.

(5) Ensure that the water analysis and study is publicly

available upon request.

(b) Costs of study.--All costs for the water analysis and

study shall be incurred by the data center developer.

Section 4. Applicability.
